Irina Ionesco dismissed face Simon Liberati and Stock – Le Figaro

Justice did not follow the photographer who demanded the removal of several passages from the book of Simon Liberati, Eva, to be published on August 19.

The photographer Irina Ionesco was finally dismissed by the High Court of Paris in the case against the writer Simon Stock Liberati and his editor. The artist had requested the deletion of seven passages from the novel by Simon Liberati, entitled Eva , and presented as a portrait of his wife Eva Ionesco through the story of their meeting, as well as 40,000 euros damages “for invasion of privacy.”

In an order issued Friday, August 7 at the end of the afternoon, the court sentenced the complainant to pay 3000 euros to the author and his publisher “under Article 700 of the Code Civil Procedure “. The text underlines in particular that the removal and prohibition of publication of the passages “are disproportionate to the proximity of the sale of the book, on 19 August, in literary season period”.

If the judge recognized that several novel elements constitute an invasion of privacy, it underlines the reputation of the artist, which assumes that several of these information has already been disclosed. He notes as well as the photographer herself had already revealed many information contained in Eva in his autobiographical novel, The Eye of the doll . It was recalled that Eva Ionesco, his daughter, had also recounted his childhood in an autobiographical film My Little Princess (2011). Between the ages of 4 and 12 years, Eva Ionesco had indeed served as a model to his mother, including updates erotic scene.

In a statement released by Master Pierrat, his lawyer, photographer regretted “the decision, which unfortunately does not take into account the damage that will be his in the context of the publication of this book.” The lawyer indicating that the photographer reserves the right to appeal continues by recalling that “should not make confusion between this procedure and an action previously by Mrs. Eva Ionesco against her mother Mrs. Irina Ionesco, which does not have the same object, the same motivation, or that is not within the same facts. “

The mother and daughter are indeed opposed to the court regarding the dissemination, the sale and exhibition of photographs representing Eva child.
